These Terms & Conditions apply to purchases made through the online store of HEART//SYSTEM Records (operated by private individuals) by Rick Fuchs & Laura Braß, Auf den Grünerlen 8B, 35713 Eschenburg, Germany.

1) Scope

We sell physical goods (e.g., merch) and digital products (e.g., downloads). Availability may vary by country.

2) Ordering & contract formation

Product listings are invitations to place an order.
By completing checkout, you place a binding order.
We accept the order by sending an order confirmation or by delivering the goods / providing download access.

3) Prices & payment

Prices shown in the store apply at the time of purchase. Shipping costs (if any) are shown during checkout.

Payment methods: Shopify Payments (incl. Apple Pay / Google Pay), PayPal, Klarna, Sofort.

4) Delivery (physical goods)

Estimated delivery times (unless otherwise stated):

Germany: 2–5 business days
EU: 4–10 business days
Worldwide: 7–18 business days

Delivery times are estimates and may vary due to carrier delays, customs, or local conditions.

5) Digital downloads

Digital products are typically made available immediately after purchase. You are responsible for maintaining access to your email/account and for compatible devices/software.

You may not share, resell, or distribute digital downloads unless explicitly permitted.

6) Returns & refund basics

Consumer withdrawal rights may apply to physical goods (see the “Right of Withdrawal” page). For digital content delivered immediately after purchase, the right of withdrawal may expire once you expressly consent and acknowledge the loss of the right (details on the withdrawal page).

7) Custom-made items

Custom-made or personalized items are produced specifically for you. Such items are generally excluded from withdrawal/returns, except where mandatory law provides otherwise.

8) Liability

We are liable for intent and gross negligence and for breaches of essential contractual obligations according to statutory provisions. In cases of slight negligence, liability is limited to foreseeable, typical damages, unless mandatory law provides otherwise.

9) Intellectual property

All content, music, and visuals are protected. Any use beyond personal, non-commercial use requires prior written permission from the respective rights holder.

10) Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of mandatory consumer protection provisions of your country of residence.
